Terms of Sale

Backgammon Circle

Terms of Sale

Version 1.0, effective from 20 November 2026

These Terms of Sale govern the purchase of paid offers provided by Backgammon Circle on backgammoncircle.com and in its mobile applications. They supplement the Terms of Use, which continue to apply to every user, subscriber or not. In case of conflict, these Terms of Sale prevail for everything relating to paid offers.

The French version of this document is the only legally binding version. This English translation is provided for information only, for users who do not read French; in case of any discrepancy, the French version prevails.

2. Definitions

Service: the Backgammon Circle online backgammon platform, accessible through the website and the applications.

Account: the personal space of a registered user, shared between the website and the applications.

Plan: one of the access levels to the Service: Free, Premium or Maestro.

Subscription: a fixed-term contract, monthly or yearly, automatically renewed, giving access to a paid Plan or to the Ad-free option.

One-time purchase: a non-renewing contract giving access without time limit, such as Maestro Lifetime access.

Founder price: the reduced rate granted to Subscriptions taken out during the founder window defined in section 6.

Store: Apple's App Store or Google Play, when the purchase is made within the application.

Payment provider: the third-party service that collects payments made on the website, identified in section 8.

3. Scope and acceptance

These Terms of Sale apply to any purchase of a paid offer by a user acting as a consumer, whatever their country of residence. Mandatory consumer-protection rules of the user's country of residence, where more favourable, remain applicable.

Purchasing a paid offer requires an active Account and prior acceptance of these Terms of Sale, evidenced by a checkbox before payment. The user acknowledges having read the essential characteristics of the offer, its price, its duration and its renewal and cancellation conditions before confirming the order.

Paid offers are reserved for adults. A minor may only subscribe with the authorisation of their legal guardian, who is deemed to have granted that authorisation by making a payment method available to the minor.

4. The offers

4.1 Plans

The Service may be used free of charge under the Free Plan. The Premium and Maestro Plans give access to additional features and quotas, described on the Subscription page of the website and in the application. The detailed content of each Plan at the date of purchase is the one displayed on that page, which forms part of the contract.

As an indication, on the effective date of these terms, the Plans differ by: the number of game analyses per day, access to course levels, the number of Arena sessions, mistake history and training, tournament participation and organisation, statistics, board themes, club creation, simultaneous play on several games and the absence of advertising.

4.2 Ad-free option

The Ad-free option is a separate Subscription that removes advertising for an Account on the Free Plan, with no other feature. It is offered only once advertising has actually been activated on the Service and is not available to holders of a paid Plan, who already benefit from it.

4.3 Maestro Lifetime access

Maestro Lifetime access is a One-time purchase giving access to the Maestro Plan for the whole period during which the Service is operated, subject to section 12. It is offered in limited quantity, announced on the Subscription page, and sold on the website only.

4.4 Prices

Prices are stated in euros, all taxes included. They appear on the Subscription page at the time of purchase. On the effective date of these terms:

OfferMonthlyYearly
Premium€6.99€49.99
Premium, Founder price€4.99€39.99
Maestro€12.99€99.99
Maestro, Founder price€9.99€79.99
Ad-free€1.00€11.00
Maestro Lifetime€255.00 one-time

Backgammon Circle benefits from the French VAT exemption for small businesses (Article 293 B of the General Tax Code): no VAT is charged. Should this regime end, or should regulations require the VAT of the buyer's country of residence to apply, the all-taxes-included price may be adjusted accordingly for new purchases and, for current Subscriptions, from the next renewal period, after notice to the subscriber under section 10.

Prices in the Stores are set according to Apple's and Google's price tiers and may differ from those on the website.

5. Free trial

Premium and Maestro Subscriptions, monthly or yearly, begin with a 7-day free trial. No trial is offered for the Ad-free option or for Maestro Lifetime access.

Only one trial is granted per Account, whatever the Plan. An Account that has already had a Subscription, even one cancelled during the trial, is no longer eligible.

A valid payment method is required at sign-up. Nothing is charged during the trial. At the end of the 7 days, unless cancelled before then, the Subscription continues at the price stated at sign-up and the first charge is made. The user is notified by email at least two days before the end of the trial.

6. Founder price

The Founder price applies to Premium and Maestro Subscriptions taken out during the founder window, which runs from the opening of paid offers until the ninetieth day after the public launch of the new version of the Service. The end date of the window is displayed on the Subscription page.

The subscriber keeps the Founder price at each renewal as long as the Subscription remains active without interruption. It is lost if the subscriber cancels and then subscribes again after the window has closed, or changes Plan or billing period after the window has closed; the change screen warns of this before confirmation.

The Founder price guarantee relates to the price excluding taxes. It does not prevent the adjustment provided for in section 4.4 in case of a change in the applicable VAT regime.

7. Ordering

7.1 On the website

The logged-in user selects an offer and a billing period on the Subscription page, reviews the summary (offer, price, duration, date of first charge, renewal conditions), accepts these Terms of Sale and, where applicable, waives the right of withdrawal under section 9, then is directed to the Payment provider's secure payment page. The contract is formed when payment is confirmed, or when the payment method is registered where a free trial applies.

A confirmation email restating the essential terms of the contract and these Terms of Sale is sent to the user. Access to the Plan is activated within minutes.

7.2 In the application

In the application, purchases are made through the Store, which acts as seller with respect to collection, invoicing, renewal, cancellation and refunds. The Store's terms apply to those matters; these Terms of Sale apply to everything else, in particular the content of the Plans and sections 10 to 13.

A Subscription taken out on the website is recognised in the application, and vice versa, as long as it is linked to the same Account.

8. Payment

On the website, payments are collected by Stripe Payments Europe Ltd, 1 Grand Canal Street Lower, Dublin 2, Ireland, or by any other provider named on the payment page, who may act as merchant of record. Backgammon Circle never has access to card data.

Accepted payment methods are shown on the payment page. Strong authentication may be required by the user's bank.

Invoices are issued by the Payment provider and available from the "Manage my subscription" area. They state that no VAT applies under Article 293 B of the French General Tax Code.

If a charge fails, the Payment provider retries several times over a period of up to three weeks, during which access is maintained. If all attempts fail, the Subscription ends and the Account returns to the Free Plan. The user may update their payment method at any time from "Manage my subscription".

9. Right of withdrawal

Under Article L221-18 of the French Consumer Code, the user has fourteen days from the conclusion of the contract to withdraw without giving any reason.

However, access to paid Plans is a supply of digital content not provided on a tangible medium, the performance of which begins immediately. Under Article L221-28, 13°, a user who requests immediate performance and expressly acknowledges losing the right of withdrawal, through the checkbox provided before payment, can no longer exercise it once access is activated.

A user who has not waived the right of withdrawal may exercise it by sending an unambiguous statement to contact@backgammoncircle.com, or using the form in the appendix. The refund is made within fourteen days of receipt of the request, by the same payment method, less an amount proportional to the service provided up to notification of withdrawal.

During the free trial, the user may in any event cancel free of charge without being billed.

For purchases made in the application, the Store's withdrawal and refund terms apply.

10. Term, renewal and cancellation

10.1 Term and renewal

Subscriptions are concluded for one month or one year depending on the billing period chosen, starting at the end of the free trial or, failing that, at payment. They renew automatically for the same term, at the price in force at sign-up or as amended under these terms, unless cancelled.

In accordance with Article L215-1 of the French Consumer Code, Backgammon Circle informs yearly subscribers by email, no earlier than three months and no later than one month before the renewal date, that they may choose not to renew. Monthly subscribers receive a reminder at least three days before each charge if they request it in their email preferences.

10.2 Cancellation by the subscriber

The subscriber may cancel at any time, without reason or fee, from the "Manage my subscription" area in their Account or, for a Subscription taken out in the application, from the Store's settings. Cancellation takes effect at the end of the current period: the subscriber keeps their benefits until that date and is not charged afterwards. No refund is due for the current period.

Until the effective date, the subscriber may undo the cancellation and resume the Subscription on the same terms.

On the effective date, the Account returns to the Free Plan. Account data (games, analyses, progress) is kept. A new Subscription may be taken out at any time, without a new free trial.

10.3 Changing Plan or billing period

Moving to a higher Plan takes effect immediately; the price difference for the current period is charged pro rata, except during a trial. Moving to a lower Plan or changing the billing period takes effect at the end of the current period. The change screen shows, before confirmation, the effects of the change, its date and the applicable price. A scheduled change may be cancelled until its effective date.

10.4 Cancellation by Backgammon Circle

Backgammon Circle may terminate a Subscription as of right in case of serious or repeated breach of the Terms of Use by the subscriber, after reasoned notice. In that case no refund of the current period is due. Backgammon Circle may also terminate any Subscription if the Service is discontinued, under section 13.

11. Changes to offers and prices

11.1 Plan content

Backgammon Circle may change the content of the Plans to adapt them to technical developments or usage, provided the change involves no additional cost for the subscriber. Adding features or raising quotas applies immediately. Any change that reduces the subscriber's access to a feature or quota is notified by email at least thirty days before it takes effect. A subscriber who refuses it may cancel free of charge within that period; a yearly subscriber is then refunded pro rata for the unused period.

11.2 Prices

Any price change is notified by email at least thirty days before it applies, and it can only apply from the next renewal. A subscriber who refuses it may cancel before that date. Founder prices are protected under section 6.

12. Maestro Lifetime access

Maestro Lifetime access is granted for the whole period during which the Service is operated by Backgammon Circle or any successor, from payment. It is attached to the buyer's Account and is neither assignable nor transferable.

The buyer's current Subscriptions end at the expiry of their already-paid period, without refund of that period; the purchase screen informs the buyer of this before confirmation.

The buyer benefits from changes to the Maestro Plan under section 11.1.

If operation of the Service ends permanently less than three years after purchase, Backgammon Circle refunds a fraction of the price equal to the number of full months remaining until the third anniversary of the purchase, divided by thirty-six. After three years, no refund is due.

Lifetime access is lost, without refund, if the buyer deletes their Account, of which they are warned before confirming deletion, or if the Account is terminated for serious breach of the Terms of Use.

13. Availability and conformity

Backgammon Circle undertakes to provide a Service conforming to the description of the Plans. If the Service is unavailable for reasons attributable to Backgammon Circle for more than seventy-two consecutive hours, the current Subscription period is extended by an equivalent duration or, at the subscriber's request, refunded pro rata.

Game analyses and play-quality indicators are produced by computing engines (GNU Backgammon, WildBG). They are provided for information and are not a guarantee of accuracy.

The statutory conformity warranties for digital content and services (Articles L224-25-1 et seq. of the French Consumer Code) apply.

If the Service is permanently discontinued, subscribers are informed at least sixty days in advance; current Subscriptions are refunded pro rata for the unused period and Lifetime access is handled under section 12.

14. Customer service and mediation

Any question or complaint may be sent to contact@backgammoncircle.com. Backgammon Circle undertakes to reply within fifteen days.

In case of an unresolved dispute, a consumer user may use, free of charge, the consumer mediator to which Backgammon Circle belongs:

CNPM Médiation Consommation, 27 avenue de la Libération, 42400 Saint-Chamond, France. Website: www.cnpm-mediation-consommation.eu. Referral is made online or by post, after a prior written complaint to Backgammon Circle has remained without satisfactory answer for two months.

15. Miscellaneous

These Terms of Sale are governed by French law, without prejudice to more protective mandatory rules of the consumer's country of residence. They are written in French, the only legally binding version; the English translation is provided for information. In case of any discrepancy, the French version prevails.

Backgammon Circle may amend these Terms of Sale. The version applicable to a purchase is the one accepted at the time of the order; any amendment applicable to current Subscriptions is notified under section 11.

If any provision is held invalid, the others remain in force.
